TERMS AND CONDITIONS FOR ONLINE SALES OF TICKETS

1. Terms and Conditions for online sales of tickets and ( further refer to as “Online Terms and Conditions” or “OTC” ) are the specific regulations for online transactions only and an integrant part of the Cinema City General Terms and Conditions (GTC). Before you purchase your tickets, please get acquainted also with the full General Terms and Conditions as they are the general framework applicable and mandatory for all Customers and complete the present OTC.  They are published on the website www.cinemacity.rо (the "Website") and placed within cashiers’ desks in multiplexes at Customers’ disposal, as specified in GTCs.

2. The terms and conditions for online sales of tickets for movie screenings in Cinema City multiplex cinemas apply to the relationship between Cinema City and all its customers in connection with the online sale of tickets and are applicable in all multiplexes operated by Cinema City. They are published on the Website, and are available to customers at the ticket offices of multiplexes, as specified in the TCG.

3. The terms and conditions for online sales are part of the Online Ticket Purchase Agreement between Cinema City and each Customer and shall be binding upon the Customer from the moment they click the "Accept" button next to the "I have read and agree to the Cinema City Terms and Conditions" field on the online ticket platform on the company's website or mobile applications. The purchase of tickets online for a movie or other event/special screening is considered a contract for the provision of leisure services, whereby the Company undertakes to provide this service at a specific time or during a specific period and, as such, the Customer cannot withdraw from the contract as provided for in Article 16, letter l) of Government Emergency Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and supplementation of certain normative acts, with subsequent amendments and additions.

4. If the Customer does not agree with the online Terms and Conditions, they may express their disagreement by not clicking the button"Accept" , and the purchase will not be completed. In such a situation, the Customer can only purchase tickets from the ticket offices or from the ticket machines located in Cinema City multiplexes, in accordance with the TCG .

PRICES AND DISCOUNTS

5. Ticket prices for films screened in various multiplex cinemas operated by the Company are listed on the website, in the "Summary and prices" section.
Ticket prices vary depending on the area chosen by the customer, namely Area A, Area B, and Area C. Area B is the standard area, located in the center of the theater, where a standard rate applies. Zone A includes seats located at the top of the hall, for which the rate is higher due to the perspective and visual experience offered. Zone C includes seats in front of the screen, for which the rate is lower, as they are not in the optimal viewing position.
This price differentiation reflects the position and comfort offered by each zone in relation to the screen, allowing customers to choose the option that best suits their preferences and budget.
At the same time, at the Cinema City Iasi Iulius Mall, zone "A" has been replaced by the Comfort zone. Zone C is always located in front of the Comfort zone, and zone B is always behind it. The Comfort zones are part of the regular 2D/3D theaters, with two dedicated rows in each of the five theaters where regular programs are shown.

6. Vouchers, promotional codes, access cards, competition tickets, and marketing tickets are not tickets that can be purchased electronically and are subject to the rules applicable established in the GTC and/or other types of rules.

7. The categories of shows for which tickets can be purchased online are:

  • Movies shown in standard, IMAX, or 4Dx 4Dx cinemas;
  • Movies playing in VIP theaters; 
  • Other alternative shows, such as Theater at the Cinema;

8. All prices mentioned on the website or in mobile applications are in lei . Cinema City reserves the right, without prior notice, to change ticket prices from time to time at its own discretion. Tickets already purchased will not be affected by the price change. The prices shown on the website or in mobile applications are final prices, including all taxes and fees and excluding exceptions regarding surcharges for the purchase of glasses mentioned in the GTC and the cost of the online service mentioned below.

9. Online service fee. For the online ticket purchase service, a fee will be charged for processing the Customer's online order. This will be paid by the Customer for each ticket purchased, in the amount expressly indicated next to the ticket price at Step 1 "Ticket selection" on the online ticket sales platform, on the company's website . Cinema City reserves the right, without prior notice, to change from from time to time the value of the online service, at its own discretion. The value of the online service for tickets already purchased will not be affected by the change.

10. The cost of the online service is charged for the maintenance of the online ticket purchasing system, the processing of the Customer's order, and the option to choose seats in advance in the movie theaters. The cost of the online service helps Cinema City maintain and improve the online purchasing system.

11. The final amount payable for the online ticket includes the ticket price plus the Online Service Fee indicated next to the ticket price in Step 1 "Select Tickets" as mentioned in point 9. If the Customer does not agree to pay the online service fee, they have the option to purchase the ticket at the ticket offices in the multiplexes. In the event of a refund of the ticket price in accordance with the procedure set out in OTC, the online service fee is non-refundable.

STAGES OF THE ONLINE TICKET PURCHASE PROCEDURE

12. To purchase tickets for a movie online, the Customer must access the company's website: www.cinemacity.rо or the mobile applications Cinema City for iOS and Android. No pre-registration on the website is required. Tickets can be purchased online from the Cinema City website, either through MyCinemaCity account or in visitor mode, which does not require the creation of an account. A user account must be created for purchases through mobile apps. 

13. A maximum of 10 tickets can be purchased per online transaction. Payment for a single order will be made once, in full, and will cover all tickets included in the order.

14. To purchase ticket(s), the Customer must access the "Program" section on the website or select a movie from the company's website and follow these steps:
STEP 1:
If you started from the "Program" section - select a multiplex cinema, date, and movie, then click on the desired movie viewing time
or 
If you started the process by directly selecting a movie - choose a multiplex cinema and date, then click on the desired movie screening time.
STEP 2: 
Select the following buttons:
•    Buy tickets and press the "Next Step" button.
STEP 3: Select seats and the category in the desired cinema hall
The customer cannot leave an empty seat between the selected seats (between the selected seats and the rest). Also, depending on the seat chosen in the hall, the price category of the ticket may differ.
Please note that once you have selected your seats, you have 10 minutes to complete your order and make a successful payment. Expiration of these limits will result in the seats being released, and the ticket purchase process must be restarted by the Customer.
Please note that Cinema City is not responsible for incorrectly entered email addresses, as our system does not inspect or verify them. The Customer is fully responsible for the accuracy of all data provided during the ticket purchase process.
STEP 4: Selecting the type and quantity of tickets you want
STEP 5: Enter your first name, last name, and email address. The email address is necessary to allow Cinema City to send you the order confirmation and the purchased e-tickets and to contact you in case of a possible change in the screening time and/or unexpected cancellation.
Before clicking on the "Next" button and being redirected to the PayU payment service provider's website to pay for your order, please check it carefully. If you agree with your order, check "I have read and agree to Terms and General Conditions of Cinema City " and then click the "Next" button.
Before placing an order, it is important for the Customer to ensure that the location of the multiplex cinema, the film, the time, the cinema hall, and category, the seats selected are the ones desired, as it will not be possible to change or refund tickets in case of error.
After clicking the "Next" button, the website redirects the Customer to the website of the payment service provider PayU to pay for the tickets by card. If you do not agree to pay via the PayU payment processor, you have the option to purchase tickets directly from Cinema City ticket offices or from the ticket machines without the possibility of booking tickets online.
STEP 6: On the PayU website, the Customer will fill in their payment card details and press the "Pay now" button. By clicking the "Pay now" button, the Customer confirms that the order is correct and it is linked to a payment obligation, and pays the price of the tickets ordered together with the cost of the online service for processing the order.
After pressing the "Pay now" button confirming the card payment by the Customer, this payment is implemented in the banking system.

15. Online payment for tickets ordered by the Customer is required for the ticket to be issued and delivered to the Customer. Payment must be made within 10 minutes of placing the order. Upon expiration of the payment term without making the payment, the seat will be released and the Customer must start over for a new ticket purchase. Bank fees and charges charged by the Customer's bank for online transactions are the sole responsibility of the Customer.

16. After the electronic transaction has been successfully completed, the Customer will receive an email at the contact email address (e- mail ) specified by the Customer in the order (please check your Spam/Junk folder if you cannot find the email in your Inbox) or directly in the mobile applications – which is the confirmation of the transaction by Cinema City with the order registration number and the corresponding number of e-tickets purchased by the Customer, as well as a link to Terms and Conditions General Terms and Conditions and OTC (Terms and Conditions for Online Ticket Sales). If the Customer does not receive confirmation of their order, they must complete the contact form on the website under the "Contact Us" section, or write to us at the email address [email protected] or call the phone number 021.301.09.06 every day (Monday – Friday), between 10:00 and 18:00.

17. By using the online ticket purchase option, the customer will avoid queuing at the ticket office. The customer will have the electronic ticket on their smartphone or similar device so that it can be scanned at the cinema entrance.

18. By accepting the General Terms and Conditions, including the Online Terms and Conditions, the Customer expressly agrees that the distance contract concluded with Cinema City will be sent to the email address provided by them. The customer is bound by the online ticket purchase contract from the moment they click the virtual "Pay now" button and make the payment, and Cinema City is bound by the contract from the moment it receives confirmation of the order placed and its payment by the customer.

19. Access to the cinema halls is granted either by presenting the tickets issued at the ticket offices or by presenting the "electronic ticket" purchased online or through mobile applications.

20. If the Customer discovers any deficiencies in the use of the online order form for purchasing tickets online placed on the website, which prevents them from making the purchase online or using mobile applications, the Customer may contact the Company at the following email address: [email protected] to resolve the impossibility or difficulties encountered in the process of purchasing tickets online. For additional information, the telephone number: 021.301.09.06 and email - [email protected] , are available to the Customer between 10:00 and 18:00 from Monday to Friday.

PAYMENT METHOD

21. Payment for electronic tickets ordered by the Customer is made through the payment service provider PayU SA, Poland, using one of the types of bank cards specified on the online payment platform - VISA, MASTERCARD, and MAESTRO. When processing the payment, the security of the card details is guaranteed by PayU SA. The Customer provides their card details and authentication data only on the PayU website for online card payments, and Cinema City does not have access to the content of the confidential data exchanged between the cardholder, PayU, and the card issuing company. Cinema City does not receive information about your card details and is not responsible for protecting it against unauthorized access. Given that the credit card payment service is not provided by Cinema City, the Company is not responsible for the manner of provision and quality of the service.
Electronic tickets can also be paid for using Pluxee and Edenred gift cards, under the terms and conditions and through the platforms specific to these providersvouchers or .

USE OF TICKETS PURCHASED ONLINE

22. Each electronic ticket is valid only for the multiplex cinema specified therein and for the film, cinema hall, seats in the cinema hall, date, and time of viewing mentioned on the ticket.

23. The holder of a ticket purchased online is not entitled to any privileges when entering the cinema/ticket offices/café/ bar and must wait their turn like other customers.

24. Each ticket entitles the holder to admission only to the screening marked on it, at the specified date and time, and only to the cinema hall assigned by Cinema City for that screening and to the seat indicated on the ticket. The duration of the Customer's visit to the cinema is determined by the duration of the screening. Immediately after the screening ends, the Customer is required to leave the theater, even if they have a ticket for the next screening in the same cinema.

25. Customers are required to keep their tickets from the moment of purchase until the end of the screening for which they were purchased and until they leave the multiplex cinema. Cinema City is not responsible for deleted, stolen, lost, destroyed, or damaged tickets and is not obligated to reissue them or refund the amount paid for them, the cost of the online service, and the price paid for 3D glasses, or to offer any other compensation.

RESTRICTIONS ON THE USE OF TICKETS PURCHASED ONLINE

26. When choosing a film for which they purchase tickets online, Customers must take into account the age restrictions arising from the classification of films by the National Film Center, as described in the TCG. Access to Cinema City cinemas for persons under the age of 18 will be subject to the rules specified in the General Terms and Conditions. Compliance with the rules imposed by the CNC when purchasing tickets online is entirely the responsibility of the Customer.

27. In order to comply with the rules imposed by the CNC, Cinema City has the right to verify the age of Customers who have purchased tickets online to ensure that the age requirements resulting from the classification of films are met. Verifications are carried out during the verification process online ticket and the Customer's access to the film screening. Cinema City may refuse access to a Customer whose age does not meet the requirements resulting from the film classification, even if the ticket has already been purchased. In this case, Cinema City shall not be obliged to refund the price paid by the Customer for the ticket purchased online, 3D glasses and/or the cost of the online service, nor to exchange the ticket for a ticket to see another film, nor shall it provide any other compensation. Furthermore, Cinema City is not obliged to compensate or reimburse the Customer for any products purchased from the café/ bar of the respective location to be consumed in the cinema to which access is denied.

28. When choosing a ticket category (at a reduced price , which applies, for example, to tickets for children, students), Customers should consider whether they meet the requirements for purchasing reduced tickets. During the inspection of a discounted online ticket, before a Customer enters the cinema, they are required to provide staff with a document certifying their right to use the discount. Failure to provide such a document or if it is determined that the eligibility conditions are not met for obtaining a discounted ticket is sufficient reason for Cinema City to refuse the Customer access to the screening with the discounted ticket purchased. The documents proving eligibility for the purchase of a discounted ticket are listed in the General Terms and Conditions available on the Website, in the "DISCOUNTS" section.

29. A person who has purchased a discounted ticket online cannot exchange it or give it to another person, unless that person meets the requirements to receive a discounted ticket in the same category. However, if such acts have been performed, the person who receives a discounted electronic ticket without being entitled to purchase it, for reasons related to that person, will not be allowed access to the screening to which the ticket purchased online refers.
30. Cinema City has the right to refuse access to film screenings in the event of presentation of an invalid online ticket - a ticket that has not been paid for or that is altered, illegible, forged,modified or in any way. Only persons presenting a valid and

undamaged ticket purchased online will be granted access to film screenings.

CANCELLATION OF TICKETS PURCHASED ONLINE 

31. An online order that includes more than one ticket purchased online through the same transaction cannot be modified, exchanged, or returned, and the number of tickets included in it cannot be reduced or revalidated for other films, dates, times, or screenings, for the reasons specified in these OTC. Tickets purchased together through the same electronic transaction are considered a single unit, and any change permitted to any of them automatically affects the other tickets included in the order. Canceling a ticket from a single order will automatically cancel the entire order. Also, in the case of family packages, the cancellation of a single ticket in the package will result in the cancellation of the entire package.

32. Customers have the right to cancel tickets purchased online through their MyCinemaCity account or from the mobile app available in the App Store or Play Store, but no later than 2 hours before the start of the movie screening for which the ticket was purchased.
The purchase price of the ticket for the movie screening will be refunded exclusively to the bank account from which it was paid, within [⦁] days from the date of cancellation. The cost of processing the order as set out in point 9 is non-refundable. Tickets purchased online from theCinema City website, in visitor mode (without being purchased through the MyCinemaCity account or the mobile app) are subject to the cancellation procedure for tickets purchased physically at the ticket offices, no later than 2 hours before the start of the film screening for which the tickets were purchased.
To exercise their rights under this paragraph, customers must present Cinema City with the valid online ticket and complete and sign a cancellation and refund form for the online ticket at the multiplex cinema for which the ticket was purchased.
For tickets purchased in person ator ticket machines ticket offices , customers may cancel them only at the multiplex cinema where they were purchased, but no later than 2 hours before the start of the film screening for which the tickets were purchased. To exercise their rights under this paragraph, customers must present Cinema City with a valid ticket for viewing and complete and sign a ticket cancellation and refund form at the multiplex cinema for which the ticket was purchased.

33. If the screening of the film is interrupted or canceled for technical or other reasons attributable to Cinema City, has the following options:
• will refund the Customer, at their request, the price of the electronic ticket to the bank account from which the amount was paid; under no circumstances will the refund be made to a bank account of the Customer other than the one from which the payment was made; This option is only possible if the film has not yet started and in compliance with the provisions of point 32
or
•    the Customer will be issued a voucher for the same value as the price of the tickets purchased, excluding the cost of the online service; This option is possible if the film has started and/or the cancellation takes place less than 30 minutes before the start of the film. In this case, the provisions of this point are corroborated with the provisions of point 23 of Cinema City's General Terms and Conditions. 

34. In none of the above cases shall Cinema City owe the Customer any damages, including, but not limited to, transportation costs, parking costs, costs for 3D glasses, food, beverages, etc. To take advantage of the rights presented, the Customer must present Cinema City with a valid online ticket for the screening that was suspended or canceled within 2 days of the date of the canceled/suspended screening and complete and sign a ticket replacement/revalidation form at the multiplex cinema where the ticket was issued.

35. In the event of interruption, cancellation, or replacement of the screening for technical or other reasons that cannot be ly attributed to Cinema City, the rules specified in General Terms and Conditions of Cinema City shall apply.

LIABILITY

42. Cinema City does not exchange, reissue, or refund amounts for stolen, lost, or damaged online tickets.

43. Cinema City is not responsible for the execution of payment transactions in connection with the online purchase of tickets by customers and for the security of customers' internet payments, nor for any damages (including losses and lost profits) incurred by customers in connection with or arising from the online payment for tickets through the payment service provider PayU SA, Poland, as the services related to the acceptance and processing of payments are provided by payment service providers and technical service providers other than the Company.

44. Without prejudice to mandatory legal provisions, Cinema City's liability in connection with or arising from the services offered by the Company and/or its activities as a film operator managing the multiplexes specified in Cinema City's General Terms and Conditions shall be limited to intentional misconduct and gross negligence and in terms of property - to the amount paid by customers for the respective services (e.g., the price of the ticket purchased online, the price of 3D glasses , etc.). 

RECOMMENDATIONS, COMPLAINTS, AND COMMENTS

45. The customer may send a recommendation, comment, or complaint regarding the online ticket purchase process via the website or mobile applications by filling out the contact form on the company's website, in the "Contact Us" section.
MISCELLANEOUS

46. For all matters not expressly covered by these Terms and Conditions for online ticket sales, the General Terms and Conditions and/or Romanian law shall apply.

47. In the event of disputes between customers and Cinema City, the parties shall make all reasonable and necessary efforts to resolve the dispute amicably through negotiation and mutual concessions. If no agreement is reached, the dispute shall be resolved in accordance with Romanian law.

GDPR 

48. In connection with the online ticket purchasing process through the S website and mobile applications, the Customer shall provide the Company with the Customer's personal data. The controller of personal data is the Company. You can contact us, as well as our data protection officer, in matters related to your personal data by:
• sending an email to:[email protected] or
• mail to: Cinema City SRL, Str.Dr. Alexandru Boicescu, nr. 10A, et. 2, biroul nr. 1, Sector 5, București (note: marketing manager).

  • Although the provision of personal data by Customers is voluntary, it is necessary for the reasons indicated in point 3 below, in particular to purchase cinema tickets online. Therefore, without customers' personal data, we are unable to properly implement the above-mentioned objectives.
  • Personal data is processed for the purposes described in the Privacy Policy and includes: 

a) processing to enable the proper implementation of the services/products ordered (legal basis for processing: Article 6 paragraph (1), letter (b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("GDPR"),
b) consideration of any complaints, archiving or current contact related to the service/product ordered - based on our so-called legitimate legal interests, which are respectively: clarification of issues, defense or resolution of claims, the need for ongoing contact (basis: Article 6(paragraph 1, letter ( f) of the GDPR),
c) improving our products and services, developing new products and services, and marketing our own products and services (in the traditional form), which are our legitimate interests (basis: Article 6, paragraph (1), letter (f) of the GDPR),
d) with separate consent - processing in the area covered by the given statement, for example, when you agree to receive promotional emails from us (basis: Article 6(1)(a) of the GDPR).
e) enabling Cinema City to comply with its legal obligations regarding accounting or civil/consumer dispute resolution (basis: Article 6(1)(c) of the GDPR, in connection with the specific provisions of the applicable law).

  • When the Customer purchases tickets, their personal data will be provided to the payment operator that operates the online payment services, solely for the purpose and to the extent necessary to enable payments to be made. The payment entity to which the data is made available will be considered a separate controller of this data. The Customer himself provides the payment operator with his payment details (this data is not stored by the Company). We would like to inform you that you have the right to access and correct your data with the payment operator as well.
  • The personal data of customers provided to the Company will not be disclosed to third parties, except in cases specified in detail in separate clauses of consent for the processing of personal data, the provisions of the Terms and Conditions, cases of disclosure of data to employees or collaborators of the Company or entities that provide support to the Company on the basis of agreements concluded to entrust the processing of data (in particular: IT support, IT system management, legal consulting services) or cases specified by law (such as, for example, sharing personal data contained in paper correspondence with postal operators or carriers to deliver correspondence, sharing personal data with state authorities).
  • The company informs that requests for consent are addressed to persons with full legal capacity , who can make such a statement on their own behalf, and to persons with limited legal capacity who act with the consent of a parent or legal guardian and have obtained their consent to take actions to conclude a contract and make statements (including consents) in accordance with these regulations and the privacy policy.
  • The Company ensures that personal data provided to the Company's web y by Customers will be protected by technical means that ensure the highest level of security of customers' personal data in accordance with applicable regulations;
  • The Company informs the Customer that they may have the opportunity to take advantage of promotions currently organized by the Company. The details and conditions of the promotion will be described each time in separate promotion regulations made available to Customers via the website. Accessibility to the promotion is possible under the conditions specified in each case in the promotion regulations. The Company informs that the personal data of the Customer using the promotion will be processed only for the purposes indicated in the promotion regulations, in particular to confirm that the conditions for participation in the promotion and its implementation have been met and to consider any complaints.
  • The Company informs that the data subject has the right to access and rectify, delete, restrict processing, the right to data portability or to object to processing, the right to withdraw consent at any time without affecting the lawfulness of data processing prior to revocation. The data subject has the right to lodge a complaint with the data protection authority (National Supervisory Authority for Personal Data Processing, B-dul G-ral. Gheorghe Magheru, no. 28-30, Sector 1, postal code 010336, Bucharest, Romania), if they consider that the processing of their personal data violates the provisions of the GDPR.
  • the data will be processed until the purpose for which it was collected is achieved and for archiving purposes - no longer than is necessary until the deadline for submitting a request for the service provided expires. If we process the data with consent, it will be stored until the consent is withdrawn.
  • The Company informs the Customer that they may participate in currently available promotions organized by the Company. The detailed terms and conditions of a promotion are specified in the terms and conditions of a promotion, which are provided to the Customer via the website. Participation in a promotion is possible based on the conditions set out each time in the terms and conditions of a promotion. The Company informs that the personal data of the Customer participating in a promotion will be processed only for the purposes indicated in the terms and conditions of a promotion, in particular to confirm that the Customer is entitled to participate in the promotion and its development and to examine any complaints. The provision of personal data is voluntary, and the Customer is entitled to access and rectify the data.

COMPLAINTS

49. The Customer may file a complaint regarding the online ticket purchase process using the website or mobile applications within 7 (seven) calendar days from the date of purchase. The complaint may be sent to the Company by email to: [email protected] .

50. In the complaint, the Customer shall specify the subject matter of the complaint and the transaction number. The Company shall not be liable for any incorrect purchase made by the Customer, in particular for the provision of incorrect or untrue data.

51. The complaint shall be examined and resolved by the Company within 20 business days from the moment it receives the complaint. The Company shall inform the Customer of its decision by email within the above-mentioned period.
FINAL PROVISIONS

52. The online terms and conditions are available free of charge at, allowing them to be downloaded, saved, and printed, as well as at the ticket offices of multiplex cinemas.
